We have heard both sides.
The first information report alleges serious interpolation in the revenue records alleging that relevant page has been torn out of the record book. The entries have been made in a different handwriting in a different ink and the page which has been added subsequently is different from other pages. The obvious beneficiary of this whole exercise are the petitioners who have applied for mutation on the strength of such revenue entries.
Learned counsel for the petitioners has not been able to disclose anything either during argument or in the writ petition as to on what basis the names of the predecessors in title of the petitioners came to be recorded in this manner in the revenue records.
In such serious and transparent interpolations in the revenue records, it would be most undesirable for the writ Court in its discretionary jurisdiction either for quashing the first information report or for staying the arrest.
The writ petition is accordingly dismissed.
