The petitioner was given a supplementary bill on 21.10.2004. He had filed appeal/complaint before respondent no. 2, which was dismissed on 12.02.2007. Petitioner filed writ petition, which was allowed on 23.05.2007 directing the respondent no. 2 to decide the matter within 2 months. The petitioner's appeal has been dismissed on 29.08.2007. Hence present writ petition.
We have heard counsel for the petitioner and Sri H.P. Dubey, counsel for respondent no. 1 & 3 .
The appeal has been dismissed on 29.08.2007 on the ground that it is not maintainable and the petitioner should approach Consumer Grievance Redressal Forum. There is no illegality in the order.
It is open to the petitioner to approach Consumer Grievance Redressal Forum and is also given liberty to file stay application.
With these observations writ petition is dismissed.
