Harsh Publicity & Others v. Shri Mani Prasad Mishra, Nagar Aayukt, Kanpur N.Nigam & Anr. - CONTEMPT APPLICATION (CIVIL) No. - 3511 of 2007 RD-AH 16074 (27 September 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon. Tarun Agarwala,J.
The applicants allege non-compliance of the orders of the Writ Court dated 28.5.2007 and 11.7.2007. The applicants contend that inspite of a specific direction to the opposite parties not to remove the hoardings, the same has been removed and therefore, the opposite parties are in willful disobedience of the order of the Writ Court. The orders dated 28.5.2007 and 11.7.2007 contemplates, that till such time as the renewal application are not disposed of by the authority, the existing hoardings would not be removed. The applicants further allege that based on the interim orders, the licence fee was paid by them upto the period 31.7.2007. It has been stated in paragraph No.10, that the opposite parties have rejected the application for renewal of their arms licence by an order dated 24.7.2007. Consequently, in my opinion, after the rejection of the renewal application by the authorities, the removal of the hoardings does not, in my opinion, violate the interim orders passed by the Writ Court. In my opinion, appropriate remedy for the applicants is to file an interim application in the writ petition.
The contempt application is dismissed with the aforesaid observation.
