Mohd. Sahanawaj v. Worksman Compensation Commissioner/Deputy Labour & Others - WRIT - C No. - 47705 of 2007 RD-AH 16159 (1 October 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon'ble Ashok Bhushan, J.
Heard counsel for the petitioner.
By this writ petition the petitioner has prayed for quashing the orders dated 4.8.2007 and 3.1.2007. A claim petition has been filed by the respondents No. 2 and 3 under the Workmen Compensation Act, 1923. Evidence of the claimant were led. The petitioner was given several opportunities to cross-examine the witnesses which he failed to avail. The Workmen Compensation Commissioner has rejected the petitioner's application to grant further opportunity. By rejecting the application of the petitioner, the petitioner has been given opportunity to lead evidence. I do not find any error in the order rejecting the claim of the petitioner for giving further opportunity to cross- examine. Petitioner having given opportunity to cross-examine the witnesses on several occasions. The said opportunity was rightly refused to the petitioner.
No ground made out for interference in exercise of writ jurisdiction Under Article 226 of the Constitution.
The writ petition is dismissed.
