Proceedings under Section 122B of the U.P.Zamindari Abolition & Land Reforms Act were initiated against the petitioner. The petitioner denied to be in possession and alleged that the wife of one of his sons was given possession of the disputed land. The Tehsildar by the order dated 13.9.02 dropped the proceedings. Against that order the state filed a revision which has been allowed by the Addl.Collector, Fatehpur by order dated 11.6.07 and the case has been sent back for fresh decision directing the Tehsildar to make a spot inspection and to take appropriate proceedings. The finding is that the land in question is a talab. It appears that the petitioner is the Pradhan of the village. The order is one of remand and good reasons have been given for the remand in the order impugned. No ground for interference under Article 226 of the Constitution of India has been made out. Dismissed.
