HIGH COURT OF JUDICATURE AT ALLAHABAD

Hon'ble Janardan Sahai, J.

The petitioners' case is that they were granted fishery lease in respect of a Gaon Sabha pond on 27.5.2007 for a period of ten years. The prayer in this writ petition is for a mandamus commanding the respondents to renew the fishery lease of the petitioners the application for which is pending since 16.8.2007. The petitioners lease was granted in 1997, which has already run out. The Full Bench of this Court in 2006 (62) ALR 65 Ram Kumar and others Vs. State of U. P. and others has taken the view that no renewal can be granted as it would amount to an infringement of Article 14 of the Constitution as other eligible persons would be ignored from consideration. No ground for interference has been made out. Dismissed.

4.10.2007.
