Heard counsel for the petitioners.
By this writ petition the petitioners have prayed for quashing the notice dated 28.3.2006 Annexure-5 to the writ petition. The notice has been given by the Collector asking the petitioners to appear and submit reply with regard to forged entry. Learned counsel for the petitioners submits that the petitioners' names are recorded on the basis of lease and Collector has no jurisdiction to entertain the application. The said proceedings were initiated on the basis of the application submitted by the Forest Department. The petitioners having come only against the notice, it is open for the petitioners to raise all their objections before the Collector in reply tot he proceedings. It is not a fit case to be entertained at this stage Under Article 226 of the Constitution.
With the above observation the writ petition is dismissed.
