Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation the name of the applicant has been disclosed by the mother of the deceased on the basis of doubt and suspicion. The evidence of extra judicial confession has been collected by the I.O. It is submitted by the learned for the applicant that the applicant has not made any confessional statement. There is no direct eye witness account. Nothing incriminating has been recovered from the possession of the applicant or at his pointing out. The co-accused Lorak Tiwari, whose case was on the same footing as the applicant has been released on bail on 4.1.2007 in criminal misc. bail application no. 3 of 2007.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ramashraya Yadav involved in case crime no. 255 of 2006 under Sections 302,201 I.P.C., P.S. Chandauli District Chandauli be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
