Kamlesh Chandra Sikka v. Kamesh Srivastava, Chief Engineer & Another - CONTEMPT APPLICATION (CIVIL) No. - 3580 of 2007 RD-AH 16382 (5 October 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon. Tarun Agarwala,J.
Heard learned counsel for the applicant.
By judgment dated 21.5.2007 several writ petitions were allowed. In one of the writ petitions the opposite party has filed an appeal which has been stayed by the appellate court. In so far as the case of the applicant is concerned, the opposite party has filed a belated appeal in which notices have been issued on Section 5 application. At the present moment, no order has been passed. However, since the judgment itself has been stayed in another appeal, consequently, the opposite parties were justified in keeping the implementation of the judgment in abeyance.
No contempt is made out against the opposite parties. The contempt application is dismissed.
