Heard learned counsel for petitioner and Sri Sanjay Kumar Singh, learned counsel representing the respondent University.
Grievance of petitioner is that no final decision being taken in respect of grant of permanent affiliation to petitioner institution in terms of provisions as contained under Sub-Section (2) of Section 37 of the U.P. State Universities Act, 1973 as amended upto date. Petitioner submits that inspection of the institution has already been carried out by Inspection team nominated by the University in question, and 13.08.2007 report has been submitted, but thereafter, University is sitting tight over the matter in forwarding the said report to the State Government, who is the competent authority to take decision in respect of grant of permanent affiliation of the institution with the University.
In view of submission made by petitioner, Registrar of Dr. B.R. Ambedkar University, Agra is directed to transmit the entire papers in respect of grant of permanent affiliation in relation to petitioner to the Principal Secretary, (Higher Education), Civil Secretariat, Lucknow, within three weeks from the date of receipt of a certified copy of this order. On the papers so received, Principal Secretary, (Higher Education), Civil Secretariat, Lucknow, is directed to take final decision, within next eight weeks, strictly in consonance with the provisions as contained under Sub-Section (2) of Section 37 of the U.P. State Universities Act, 1973 and other allied provisions which cover the field.
With above observations and direction, writ petition is disposed.
