Issue notice to respondent no. 4.

Learned counsel for the respondent no. 4 initiated proceedings for conciliation in which the petitioners appeared and the Deputy Labour Commissioner accepting the case of the employee that respondent no. 4 has already received all his emoluments, has dropped the proceedings by order dated 1.9.2005. Subsequently by a review application, copy of which was not served to the petitioner nor any notice was issued, the Deputy Labour Commissioner has made a reference by order dated 20.8.2007. Specific allegations have been made in paragraph 13 of the writ petition that neither copy of the review application nor any notice was given to the petitioner. The petitioner has made out a prima facie case for grant of interim relief.

Let a counter affidavit be filed within four weeks. Steps for service be taken within two weeks.

List this writ petition in week commencing 19th November, 2007.

Till the next date of listing no further proceedings shall take place in pursuance of the order dated 18.8.2007 and 20.8.2007.
