Ram Keshav Yadav v. State Of U.P. & Others - WRIT - C No. - 50955 of 2007 RD-AH 16614 (11 October 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
The petitioner had earlier filed writ petition no.10421 of 2007, which was disposed of with a direction that his representation be decided. The petitioner claims to be the inhabitant of the village. The petitioner's case was that constructions were being made by the Pradhan on plot no.265 which is reserved for play ground. The grievance of the petitioner is that his representation has not been decided but instead an order of exchange has been passed by the Sub-Divisional officer by which the plot no.265 has been exchanged for plot no.264. It is submitted that the order of this court has not been complied with as the representation of the petitioner has not been decided. The basis of the petitioner's case was that plot no.265 was reserved for play ground and constructions could therefore not be allowed. In view of the exchange of plot no.265 the basis of the contention disappears. Exchange is a separate transaction and it has been approved by the Sub-Divisional officer. No illegality in the order could be shown. No ground for interference has been made out. Dismissed.
