Ram Kishun v. Dy. Director Of Consolidation, Pratapgarh Camp Alld. & Ors. - WRIT - B No. - 50981 of 2007 RD-AH 16615 (11 October 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Against the order of the Consolidation Officer an appeal was preferred by Brij Lal, respondent no.6 which was allowed by the Settlement Officer, Consolidation and the case was remanded to the Consolidation Officer. The Settlement Officer Consolidation found that the order of the Consolidation Officer is non speaking one and he has merely given approval to the report of the Chakbandikarta and that the proceedings are wholly irregular. The case has been remanded for fresh decision on merits and also considering the question of limitation. The petitioner filed a revision, which has been dismissed. The order is one of remand. Good grounds have been given by the Settlement Officer Consolidation in the remand order. No ground for interference has been made out. The petitioner will have opportunity before the Consolidation officer. The Consolidation Officer shall try to decide the case expeditiously. With these observations the writ petition is dismissed.
