Defendants petitioners' restoration application under O-9 R-13, C.P.C. registered as Misc. Case No.91 of 2004 for setting aside the ex parte judgment and decree passed in S.C.C. Suit No.37 of 2002 (Surendra Bahel and another Vs. Smt. Meera Jain and others) has been allowed by J.S.C.C./ A.D.J., Court No.4, Ghaziabad through judgment and order dated 27.08.2007 on payment of Rs.2,000/- as costs. The grievance of the petitioner is that costs are too heavy. In the opinion of the Court, the costs are on the lower side. The court below while allowing the restoration application should have imposed heavier cost. However, as landlord has not come to this Court, hence there is no occasion to enhance the cost.
Hence, this writ petition is dismissed.
