It is stated that petitioner no.1 is tenure holder of village Bhurjini while petitioner no.2 is tenure holder of Village Rassolpur. These villages have been notified for consolidation operation under Section 4 (A) of the U.P. Consolidation of Holdings Act. The petitioners case is that the tenure holders are satisfied with their chaks and they do not want the consolidation operation to go on in the village. It is stated that a representation dated 26.5.2007 was filed by the petitioners and other tenure holders to the Consolidation Commissioner, Lucknow for cancellation of the notification under Section 4-A of the Act and the said representation is pending before the Consolidation Commissioner. It is stated that the Consolidation Commissioner is not disposing of the representation. The prayer is that he Consolidation Commissioner be directed to dispose of the representation within a time bound period.
I have heard learned standing counsel also.
In the facts and circumstances it is appropriate that the representation of the petitioners be disposed of expeditiously and if possible within a period of six months from the date a certified copy of this order is filed before the Consolidation Commissioner.
With the aforesaid this writ petition is disposed of.
