1.Heard Sri Gulab Chandra, learned counsel for the appellant. Mr. Y.K. Yadav, standing counsel appears for State-respondents no. 1, 3, 6 and 7, Sri P.S. Baghel appears for respondent no. 4 and Dr. Ashok Nigam, Addl. Solicitor General, assisted by Sri Rajesh Kumar Mishra appears for respondent no. 5, Union of India.

2.The appellant herein sought to challenge the allocation and relieving order dated 14.9.2007, whereby he was allocated to State of Uttaranchal. He is the Constable belonging to U.P. State Armed Constabulary. In view of the allocation and relieving order, he has to join in Uttaranchal. The petition filed by appellant was dismissed by Learned Single Judge. The matter is carried in appeal before us. An identical matter being Special Appeal No. 1283 of 2007 in the case of Constable Ramadhar Yadav Vs. State of U.P. came up before a Division Bench in which one of us (Hon'ble H.L. Gokhale, C.J.) was party and the Court dismissed that appeal by order passed on 25th September 2007. Inasmuch, facts of this appeal are similar to the said matter, this appeal is also, hereby, dismissed.
