The petitioner's case is that patta for agricultural purposes was granted in favour of the petitioners on 15.3.2005 and it was approved by the Sub Divisional Officer on 7.3.2005 and that the said patta to the best knowledge of the petitioner has not been cancelled but the petitioners are being orally told that their patta has been cancelled but the petitioners have not been given any copy of the cancellation order. The prayer of the petitioners ' counsel is that in case the patta of the petitioners has been cancelled, the petitioners may be supplied with copy of the order and that in case the patta have not been cancelled the same may not be allotted to any other persons.
I have heard learned standing counsel also.
In the facts and circumstances this writ petition is disposed of with the direction that the petitioners may make an application to the Collector, Etah with the prayer for being supplied with the copy of the order of cancellation if any and in case the patta has not been cancelled, it is open to the petitioners to make a representation to the Sub Divisional Magistrate in case the land is proposed to be allotted to any other persons. It is made clear that no opinion upon the merits of the petitioner's case is being expressed by this court.
