Heard learned counsel for the applicant.

The suit was dismissed in default. A restoration application was filed which was allowed and the suit has been restored. Against this order the present revision has been filed.

The learned counsel fro the applicant submitted that the opposite party had knowledge of the dismissal of the suit inspite of which he did not move a restoration application within time and by concealment of material fact, the proof of which has been filed in the supplementary affidavit, the Court has illegally and without considering the material evidence has allowed the restoration application.

By that as it may. This Court is not inclined to interfere in the impugned order. Let the suit be decided on merit.

The revision is dismissed with the aforesaid observation.
