Heard counsel for the petitioner and Sri Tarun Verma appearing for the respondent No.2.
Learned counsel for the petitioner submits that by the impugned notice dated 25.8.2007 an amount of Rs.4,800/- has been asked to be paid against the balance of Rs.34k,601/-. Petitioner's case is that he filed claim before the District Consumer Forum on 21.6.2007 which is pending consideration. It is always open to the petitioner to approach the District Consumer Forum for deciding the claim expeditiously. As stated by the learned counsel for the petitioner the petitioner is ready to pay Rs. 4800/- as demanded by the notice.
No ground is made out to quash the notice dated 25.8.2007. It is open for the District Consumer Forum to expeditiously dispose of the claim of the petitioner and the Bank shall also cooperate the same.
With the above observation the writ petition is disposed of .
