HIGH COURT OF JUDICATURE AT ALLAHABAD

Hon'ble S. Rafat Alam, J.

Hon'ble Sudhir Agarwal, J.

This is intra Court appeal against the judgement/order of the Hon'ble Single Judge dated 13.11.2007 dismissing the appellant's writ petition no. 2795 of 2007.

We have heard learned counsel for the appellant and also perused the record.

It is not in dispute that the petitioner-appellant had submitted resignation on 2.9.1999. It is also not in dispute before us that the petitioner-appellant gave statement on oath in presence of witnesses on 24.10.1999 and only thereafter the resignation of the appellant dated 2.9.1999 was accepted by order dated 26.10.1999. Thus, we do not find any factual or legal error in the judgment of the Hon'ble Single Judge.

The appeal is devoid of merit and is dismissed summarily.

Dt. 18.12.2007
