This is a second contempt petition filed by the petitioner for alleged willful disobedience of the order dated 9.5.2007 passed by this Court in Writ Petition No. 33378 of 2006 (Akash Sharma Vs. State of U.P. and others). The earlier the contempt petition was dismissed with the following observations:-
"In my opinion, no willful contempt is made out against the opposite party.
It is open to the applicant to file an appropriate application before the authority concerned bringing to its knowledge the judgment of the Court dated 9.5.2007 in the case of Akash Sharma Versus State of U.P. And others. The contempt petition is dismissed at this stage."
Learned counsel for the petitioner, however, submitted that pursuant to the order dated 13.9.2007 passed in the earlier contempt petition, he has filed a representation but the same has not been decided till date. The order dated 13.9.2007 did not fix any time for deciding the representation and only about a month has expired after filing of the representation. In such circumstances, it cannot be said that there has been any willful disobedience on the part of the respondent. It is, however, expected that the representation shall be decided expeditiously in accordance with law.
The contempt petition is, accordingly, dismissed subject to the observations made above.
