Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant and five other co-accused persons are named in the F.I.R. on the basis of the evidence of last seen. During investigation one knife was recovered at the pointing out of the applicant. The recovery is not supported by independent witness. The co-accused Saddu has been released by this court on 5.12.2006 in criminal misc. bail application no. 26627 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Amir involved in case crime no. 104 of 2006 under Sections 364,302,201/34 I.P.C.,P.S. Narsena District Bulandshahar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
