Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. The applicant and other were seen by the witnesses when they were coming out from the sugar cane field where the dead body was found. There is no other evidence against the applicant. The co-accused Jai Hind whose case was on the same footing with the applicant has been released on bail by this court on 29.11.2006 in criminal misc. bail application no. 26148 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Anser alias Ash Mohammad involved in case crime no. 251 of 2006 under Sections 302,201I.P.C., and 2/3 U.P. Gangster and Anti Social Activities(Prevention) Act P.S. Shikarpur District Bulandshahar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
