Heard learned counsel for the petitioner and learned A.G.A. appearing for the State.
We have been taken through the allegations contained in the F.I.R. and also the materials on record.
It is submitted by learned counsel for the petitioner that the arrest of co-accused has been stayed in Crl. Misc. Writ Petition No. 15815 of 2007.
Issue notice to respondent no 3 who may file counter affidavit. Rejoinder affidavit, if any, may be filed within one week thereafter.
Connect and list alongwith Crl. Misc. Writ Petition No. 15815 of 2007.
Till next date of listing or till submission of charge sheet whichever is earlier, the arrest of the petitioner namely, Ashok Kumar Chaurasiya, who is wanted in case crime No. 963 of 2007 under sections 60, 62 and 63 of U.P. Excise Act, P.S. Ghosi, district Mau shall remain stayed of course subject to the restraint that the petitioner shall fully cooperate with the investigation and shall appear as and when called upon to assist in the investigation. In case the petitioner defaults in any manner, the above order shall cease to be operative.
