By the impugned order the tribunal has allowed the application for recalling the order dated 3.7.2007 directing the case to proceed ex parte against the respondent no.1. The case of the respondent no.1, which has been accepted by the tribunal is that he had no knowledge of the date. The order is discretionary one. There is nothing to show that the discretion has been wrongly exercised. No ground for interference has been made out. Counsel for the petitioner then submitted that the tribunal be directed to dispose of the case within a time bound period. The election petition was filed in December 2006.

In the facts and circumstances of the case the writ petition is disposed of with the direction to the Additional District Judge-III, Mathura before whom the case is pending to dispose of the case expeditiously.
