The petitioner, who is a member of police force, has challenged the order dated 3rd October 2007 whereby pursuant to order of transfer dated 26th September 2007, 5th October 2007 is the date fixed for handing over charge of the petitioner.
This order, in my opinion, is an order of transfer which does not require any interference by this Court in exercise of jurisdiction under Article 226 of the Constitution of India in view of the law laid down by the Hon"ble Apex Court in the case of Mrs. Shilpi Bose and others Vs. State of Bihar and others AIR 1991 SC, 532.
Learned counsel for the petitioner has submitted that this transfer is in contravention of sub-para (11) of Para 9 of the Policy of the Government. Learned counsel for the petitioner has failed to produce any statutory provision in support of his contention. At the most it can be said that the order is in violation of Government instructions. This cannot be questioned by the petitioner in this writ petition under Article 226 of the Constitution of India.
This petition, therefore, has no force and is accordingly dismissed.
