Heard learned counsel for the petitioners, learned A.G.A. for the State and perused the record.
It is contended by the learned counsel for the petitioners that there exists a dispute in regard to the vidai of the victim and in this regard the petitioners no.1 & 2 had already made applications dated 21.9.2007 and 29.8.2007 (Annexures no. 2 & 1 to the writ petition respectively) to the Superintendent of Police, Agra. The impugned first information report has been lodged on 25.9.2007 in contrast to the above complaints, as no occurrence took place as alleged in the F.I.R., but pursuant to it the police is trying to effect the arrest of the petitioners. They are ready to cooperate with the investigation.
Considering the facts and circumstances of the case, the writ petition is finally disposed of with the direction that in case the investigation into the case crime no.618 of 2007 under Section 498-A, 506 IPC and Section 3/4 Dowry Prohibition Act, Police Station Etmadaulla, District Agra has not been concluded till today, the same shall be concluded within a period of three months from the date of presentation of a certified copy of the order and till then the arrest of the petitioners shall not be effected, provided they co-operate with the investigation.
