Heard learned counsel for the petitioner and Dr. Ashok Nigam assisted by Sri Ashwani Kumar Mishra.
In view of order proposed to be passed it is not necessary to invite counter affidavit.
The petitioner's prayer in this petition is that he has filed a statutory appeal as provided under DSR Para 364 read with the provisions of Section 27 of the Army Act, 1950 which has been annexed as Annexure-1 to the writ petition with a further prayer that the same has not yet been decided by respondent no.2 who is sitting tight over the matter.
In the facts and circumstances of the case I direct the respondents to decide the aforesaid statutory appeal within three months from the date of presentation of a certified copy of this order, if the same has not been decided.
With the above direction the writ petition is finally disposed of.
