An order was passed by the Workmen Compensation Commissioner, Azamgarh dated 24.4.2007. The petitioner filed an application for setting aside that order on the ground that the order was an ex parte one without opportunity to the petitioner. The application of the petitioner has been rejected by the impugned order dated 19.9.2007 by the Workmen Compensation Commissioner, Azamgarh. The finding recorded by the Workmen Compensation Commissioner, Azamgarh is that the order was not ex parte and the petitioner's counsel was present and the order dated 24.4.1997 was passed on merits and after hearing him. The Workmen Compensation Commissioner, Azamgarh also found that the petitioner was granted nine opportunities to adduce his evidence but he did not produce his evidence and by an order dated 14.3.2007 his evidence was closed in the presence of his counsel. The findings recorded by the Workmen Compensation Commissioner, Azamgarh are findings of fact. No ground for interference has been made out. Dismissed.
