Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the applicant was released on bail by this court on 29.11.2006 in criminal misc. bail application no. 26148 of 2006 subsequently on the basis of some evidence section 2/3 U.P. Gangster and Anti Social Activities(Prevention) Act has been added. The applicant was not involved in any other case.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Jai Hind involved in case crime no. 251 of 2006 under Section 2/3 U.P. Gangster and Anti Social Activities(Prevention) Act and under section 302,201 I.P.C.P.S. Shikarpur District Bulandshahar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
