Constable 342 Ap Rajbhadur v. The Principal Secretary, Mini. Of Home Affairs And Others - WRIT - A No. - 57552 of 2006 RD-AH 16862 (25 October 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon'ble Sudhir Agarwal, J.
Heard Sri Nisar Uddin, learned counsel for the petitioner and perused the record.
The petitioner has sought a writ of mandamus commanding the respondents to grant super selection grade and annual increment to the petitioner and also to consider him for promotion to the next higher grade.
The respondents have filed counter affidavit stating that in accordance with the Rules the petitioner was considered for grant of selection grade and has been allowed by letter dated 12.12.2006 after adding 24 years of service. A copy of the said letter/order has also been placed on record as Annexure CA-1. Learned counsel for the petitioner could not show that besides selection grade he is entitled to any other promotional scale under any rule or executive order having force of law. There is nothing on record to show that annual increment in the regular pay scale has not been paid to the petitioner. Therefore, in my view after grant of selection grade to the petitioner vide order dated 12.12.2006, no further order is required to be passed in this case.
The writ petition is devoid of any merit and is accordingly dismissed. No order as to costs.
