The petitioners have filed this petition for setting aside the orders dated 2nd April, 2007 and 8th August, 2007 passed by the Courts below. By the former order dated 2nd April, 2007, the Trial Court had merely issued notice to the defendants on the application filed by the plaintiffs under Order 39 Rule 1 of the Code of Civil Procedure and by the latter the Revision filed by them against the said order was dismissed.

Learned counsel for the petitioners submitted that as the Application under Order 39 Rule 1 of the Code of Civil Procedure has been served upon the defendants it may be decided expeditiously.

This petition is, accordingly, disposed of with a direction to the Trial Court to expeditiously decide the application filed by the petitioners under Order 39 Rule 1 of the Code of Civil Procedure.
