Rama Kant & Another v. State Of U.P. & Others - SPECIAL APPEAL No. - 1402 of 2007 RD-AH 16903 (25 October 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Special Appeal No. 1402 of 2007
Rama Kant and another vs. State of U.P. and others
Hon'ble Pankaj Mithal,J
Date: October 25, 2007
Oral Judgement (Per:H.L.Gokhale,CJ)
1. Heard Mr. S.P. Pandey in support of this appeal. Mr. A.K. Srivastava, learned Standing Counsel appears for the State-respondents.
2. The appellants herein are the Seasonal Collection Amins in the Revenue Department in district Gorakhpur. They wanted regularisation. It was necessary that the persons concerned must show that they have made collection above 70% of the target given to them. At all relevant time, the appellants failed to attain the target and therefore they could not be regularised. An earlier order of this Court directed that their representation to be considered. Their representation was considered and a detailed order was passed by the District Magistrate. That led to one more petition. The learned Single Judge has gone into all aspects and dismissed the petition.
3. Mr. Pandey, learned counsel for the appellants submits that the recoveries/collections had to be seen in proportion to the target. That is what we find from the order passed by the District Magistrate. This has also been specifically placed in the counter filed by the State to which there is no reply in the rejoinder.
4. This being the position, there is no error in the order passed by the learned Single Judge. The appeal is dismissed.
