The petitioner had taken loan from the State Bank of India. The petitioner defaulted and in pursuance of the recovery proceedings the land of the petitioner was auction sold and was purchased by respondent no.5. The petitioner has challenged the order dated 4.10.07 by which the auction has been made by the respondents 2 and 3. The petitioner has an alternative remedy of filing objections under Rule 285 I of the U.P.Zamindari Abolition & Land Reforms Rules. In view of the alternative remedy available to the petitioner, it is not a fit case for interference under Article 226 of the Constitution of India. The writ petition is dismissed on the ground of alternative remedy.
