Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. but after five days of the alleged occurrence the name of the applicant has been disclosed by the villagers. The naming of the applicant is after thought. It has been stated by the witnesses that after commission of the alleged incident, they did not disclose the name of the applicant to anybody.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Pappu alias Dileyar involved in case crime no. 216 of 2006 under Sections302 I.P.C.,P.S. Simbhawali District Ghaziabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
