Heard learned counsel for the petitioners and learned Additional Government Advocate.
It is contended that FIR has been lodged on the basis of the application under Section 156(3) Cr. P. C. by the son-in-law against his father-in-law and others. Two supplementary affidavits have been field showing that earlier the wife of the complainant had lodged FIR under sections 406/ 498-A/ 506/ 114 IPC & ?? Dowry Prohibition Act in Gujrat.
Issue notice to respondent no. 4 who may file counter affidavit within four weeks. Learned AGA may also file a counter affidavit within the aforesaid period.
Rejoinder affidavit, if any, may be filed within two weeks thereafter.
Till the next date of listing or submission of charge sheet, whichever is earlier, the arrest of the petitioners in Case Crime No. 384 of 2007, under Sections 147, 148, 149, 392, 323, 504 & 506 IPC, P.S. Kotwali, Kanpur Nagar, shall remain stayed provided they cooperate with the investigation.
