The names of the petitioners were expunged by the Up Ziladhikari. The finding is that the entry in the khatauni 1408-13 fasali is forged. The petitioners filed revision. The revision was dismissed by the Additional Commissioner. It is submitted by the petitioners counsel that the order was passed by the Up Ziladhikari without opportunity to the petitioners and the names of the petitioners are entered in the revenue record since1364 F. Counsel for the petitioners referred to Annexure-1 of the writ petition in support. The extract of the khatauni filed pertains to the year 1408-1413-F, which contains an endorsement that the entry is from 1364-F. The entry in the khatuani has been found to be farzi. The petitioner was given opportunity in the revision. The order has been passed in a summary proceeding. The order does not suffer any any illegality. It is open to the petitioners to file a suit for declaration of his rights.
With these observations the writ petition is dismissed.
