Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the record.
It is contended by the learned counsel for the petitioner that the petitioner is a practising lawyer in the District Courts. He was engaged by Vijai Singh, a co-accused in a case punishable under Sections 498A, 304B IPC and ¾ D.P. Act. The abovenamed Vijai Singh handed over the certified copy of the stay order dated 18.11.2006 passed by this Hon'ble Court in Crl. Writ Petition no.1989/06, a copy of which is appended as Annexure 3 to the petition but it was later disclosed that the order so given, was forged. His further contention is that the petitioner was not aware of the fact that the order given to him was forged and in this belief he produced the same in the court. . He is ready to co-operate with the investigation as he has committed no offence.
Considering the facts and circumstances of the case, learned AGA prays for and is granted four weeks' time to file counter affidavit.

The investigation of case crime no. 2764 of 2006 under Section 177, 182, 193, 420, 466, 467, 468, 471 IPC PS Civil Lines, Distt. Moradabad shall go on but the arrest of the petitioner shall not be effected till then, provided he co-operates with the investigation.
