The petitioner alleges violation of the interim order dated 1.9.2007 passed in Writ Petition No. 40138 of 2007. By the order dated 19.7.2007 the respondents cancelled the existing agreement in respect of running of the Food Plaza in the various Bus Depots of the petitioner. The Court by the order dated 1.9.2007 stayed the operation of the order dated 19.7.2007 and further ordered that if the petitioner is running the Food Plaza, he shall be permitted to run the same.
In the affidavit filed in support of the contempt petition, the petitioner has placed on record the communication dated 6.10.2007 sent by the opposite-parties wherein it has been specifically mentioned that the petitioner has not been running the Food Plaza after 19.7.2007 and he is only running the Canteen. In this view of the matter, it cannot be said that there is any willful disobedience of the interim order passed by this Court. Learned counsel for the petitioner submits that incorrect facts have been stated in the communication dated 6.10.2007. The petitioner, if he is so advised, may file an appropriate application in the pending writ petition.
The contempt petition is, accordingly, dismissed.
