In this appeal an order was passed by another bench on 08.08.2007, whereby the Chief Judicial Magistrate Rampur was directed to inform the appellant to engage some other counsel, as his earlier counsel Sri Kundan Singh was elevated to the Bench of this Court. The same order was repeated on 13.09.2007, whereas the Chief Judicial Magistrate Rampur, has no concern with this case, because the appellant-accused is of resident of district Agra and S.T. No. 629 of 1980, which gave rise to this appeal, was also decided by the 9th Additional Sessions Judge Agra.
Hence the office is directed to issue notice to the appellant-accused Gulab Singh through the Chief Judicial Magistrate Agra to engage some other counsel within four weeks. Notice along with copy of this order be sent by FAX to the Chief Judicial Magistrate Agra, within three days. The Chief Judicial Magistrate Agra must ensure service of the notice on the appellant-accused as early as possible and submit his compliance report.
