Heard learned counsel for the petitioner and perused the materials on record.
It is submitted by the learned counsel for the petitioner that on the basis of the allegations embodied in the F.I.R. no offence under section 304 I.P.C. is disclosed as against the petitioner.
Issue notice to respondent no. 3
Learned A.G.A. prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit if any may be filed within two weeks next thereafter. List this matter after expiry of the aforesaid period.
Till further orders or till submission of the charge sheet whichever is earlier, the arrest of the petitioner namely Nar Singh Das who is wanted in case crime No. 271 of 2007 under sections 304 I.P.C. and sections 3 (2) (5) of SC/ST Act P.S.Kotwali Varanasi shall remain stayed of course subject to the postulates that the petitioner shall fully cooperate with the investigating officer and shall appear as and when called upon to do so.
