The petitioner has approached this Court by means of this Writ petition under Article 226 of the Constitution of India being aggrieved by an order dated 1st September 2007 (Annexure-1 to the writ petition) whereby an order dated 30th June 2007 transferring one Attar Singh from Agra to Rajkiya Railway Police has been cancelled and the petitioner who has joined in place of Attar Singh has been transferred from Agra to Rajkiya Railway Police.
Learned counsel for the petitioner submits that this cannot be done in view of provisions of Paras 52 and 525 of the Police Regulations.
Be it as it may be, this Court do not interfere with the matters of transfer in view of the decision in the case of Mrs. Shilpi Bose and others Vs. State of Bihar and others AIR 1991 SC, 532.
However, if the petitioner feels aggrieved by the order dated 1st September 2007 it is always open to the petitioner to approach the higher authorities stating his grievance and it is expected that the authorities will deal with it in accordance with law.
In view of the above observations the writ petition is finally disposed of.
