Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by learned counsel for the applicants that the applicants were released on bail in the present case but subsequently due to some unavoidable circumstances, they could not appear in the court, so their bail was cancelled. They undertake that they shall appear regularly in the court during pendency of the trial. They are in jail since 16.11.2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Sayane Ali, Kasam and Ismail involved in case crime no. 2 of 1999(S.T. No.574 of 2002) under Sections 304 I.P.C., P.S. Tanda District Rampur be released on bail on their furnishing a personal bond and heavy sureties to the satisfaction of the Court concerned.
