HIGH COURT OF JUDICATURE AT ALLAHABAD

Hon'ble Anjani Kumar, J.

Heard learned counsel for the petitioner.

The petitioner by means of this writ petition has challenged the orders dated 13th September 2007 and 25th September 2007 whereby the petitioner has been transferred from Raebareli to Aligarh. Learned counsel for the petitioner submitted that this order has been passed by way of punishment. There is no material on record which may demonstrate that this order has been passed by way of punishment.

The transfer being exigency of service, this Court should not interfere with the transfer order in view of law laid down by the Hon'ble Apex Court in the case of Mrs. Shilpi Bose and others Vs. State of Bihar and others AIR 1991 SC, 532.

I do not find any error in the order impugned. The writ petition is dismissed.

Dt: 31.10.2007.
