This petition has been filed against an order in a mutation case under Section 34 of the U.P. Land Revenue Act. The petitioners claiming to be nephew of the deceased tenure holder Bhikam Lal relied upon a will and claimed mutation on that basis. The execution of the will has not been found proved by the authorities below. The finding is one of fact. According to the respondents the will relied upon by the petitioners is forged and they (respondents) are transferee of the widow of the deceased and their application for mutation has been granted by the courts below. The petitioners have already filed suit for cancellation of the sale deed . The order passed in mutation proceeding is one in a summary proceeding. It will not have any binding effect upon a regular suit. No ground for interference has been made out.
With these observations, this writ petition is dismissed.
