We have heard Sri Aroop Banerji, learned counsel for the petitioner and Sri Shobhit Dubey learned standing counsel appearing for the respondent.

In the demand letter issued by Executive Engineer, Urban Electricity Distribution Division I, Varanasi, a photostat copy of which is Annexure-1 to the writ petition, it is written that proprietor of M/s. Raghav Offset is Sri Vipul Shankar Pandya r/o B-21/122 A-1, Kamachchha, Tehsil- Sadar, Varanasi. According to the petitioner he is resident of B-1/42-A, Kamachchha, Tehsil- Sadar, Varanasi. The petitioner has made a representation dated 17.10.2007 to the Executive Engineer, filed as Annexure-2 to the petition, stating therein that he is not the proprietor of M/s. Raghav Offset nor he has got any connection of the house for which demand notice has been issued and the mistake be corrected and the name of the petitioner be removed from the recovery certificate, but no order has been passed as yet.

This writ petition is finally disposed of with a direction to Executive Engineer, Urban Electricity Distribution Division I, Varanasi to decide the aforesaid representation of the petitioner by a reasoned and speaking order, in accordance with law, within three weeks from today.

For a period of three weeks from today, the recovery proceedings initiated against the petitioner shall be kept in abeyance.

With the aforesaid directions, this writ petition is disposed of.

Let certified copy of this order be issued to learned counsel for the parties on payment of usual charges within 24 hours.
