HIGH COURT OF JUDICATURE AT ALLAHABAD

Civil Misc. Writ Petition No. 54206 of 2007

Balbir Singh

Versus

Deputy Director of Consolidation and others

Hon'ble Krishna Murari, J.

Heard learned counsel for the petitioner.

This petition arises out of chak allotment proceedings. Petitioner and respondents no. 4 and 5 are co-tenure holders. Against proposed allotment made by Assistant Consolidation Officer, petitioner filed objection which was allowed by the Consolidation Officer vide order dated 27.5.2006. Other two co-tenure holders challenged the same by filing two separate appeals. Settlement Officer Consolidation consolidated both the appeals and allowed the same. Aggrieved, petitioner went up in revision which has been dismissed by the Deputy Director of Consolidation vide impugned judgment dated 17.5.2007 which is under challenge in the present writ petition.

Settlement Officer Consolidation finding that though parties are co-sharers but entire good quality of land has been allotted in the chak of the petitioner whereas inferior quality of land has been allotted in the chak of contesting respondents made adjustment in such a manner that good quality of land and inferior quality of land came to be allotted in the chak of the parties proportionately. Deputy Director of Consolidation finding that good quality and inferior quality of land has been proportionately allotted in the chaks of the parties dismissed the revision filed by the petitioner.

In view of the findings recorded by the Settlement Officer Consolidation and confirmed by the Deputy Director of Consolidation that by the proposed adjustment the land of good quality and inferior quality has been equally allotted in the chaks of the parties in proportionate to their shares, the impugned orders do no call for any interference.

Writ petition accordingly fails and is dismissed in limine.
