The petitioner has filed an appeal against an order canceling the fair price shop agreement. The appeal is pending before the Deputy Commissioner Food, Bareilly Region, Bareilly. In the said appeal the petitioner has filed a stay application, which has been rejected. The order rejecting the stay application is an interlocutory one. There is nothing to show that the discretion exercised is perverse.
In the facts and circumstances it is directed that the appeal of the petitioner be disposed of preferably within a period of three months from date a certified copy of this order is filed by the petitioner. In the meanwhile, the shop in dispute, which the petitioner says is under attachment may continue under attachment but it will not be allotted to any other person till the disposal of the appeal.
Copy of this order be made available to the learned counsel for the petitioner within 24 hours on payment of usual charges.
