Heard Sri R.B. Singh, learned counsel for the petitioner and Dr. Ashok Nigam assisted by Sri Radha Mohan Pandey for the respondents.
Against the order dated 10.08.2005 the petitioner has filed an appeal by letter dated 06.09.2005 before the Adjutant General Branch, Army Head Quarters, New Delhi and it is said that the same has not been decided till date.
In view of above, this writ petition is finally disposed of directing the competent authority to pass appropriate order in accordance with law in respect of the aforesaid appeal/representation of the petitioner expeditiously, preferably within a period of two months from the date of production of certified copy of this order.
It is made clear that this Court has not expressed any opinion on the merit of the issue and the competent authority shall pass appropriate order without being influenced by any observation made in this order.
