Ram Bilash Ram v. Shri Ramesah Babu Gupta Dist. Asst. Registrar Coop Soc. - CONTEMPT APPLICATION (CIVIL) No. - 3935 of 2007 RD-AH 17427 (5 November 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon. Dilip Gupta, J.
The petitioner alleges violation of the judgment and order dated 11.5.2007 passed by this Court in Writ Petition No. 27357 of 1999. The petition had been filed by the District Assistant Registrar for setting aside the order passed by the U.P. Public Services Tribunal allowing the claim petition filed by Ram Bilas Ram (present contempt petitioner). The petition was dismissed and the petitioner therein was directed to deposit the costs of Rs. 50,000/-.
It has been stated in the affidavit filed in support of the contempt petition that inspite of the aforesaid order, the salary to the petitioner has not been paid. It is open for the petitioner to get the order of the Tribunal executed but it cannot be said that there is any wilful disobedience of the order passed by this Court.
The contempt petition is, accordingly, dismissed.
